What are the responsibilities of enterprises under CLP regulations?
1. Recategorize
1) Annex VI of CLP regulations; 2) Collect industry, enterprise, and public data to get classification; 3) Track SIEF information and get classification.
Requirements for testing: Toxicological and ecotoxicological data are not mandatory, but physical and chemical data are mandatory. Testing can be exempted by looking for public data recognized by ECHA.
2. Update product labels and packaging (must ensure labels are updated in a timely manner in accordance with CLP requirements)
New hazard icons, hazard description sentences, safety precautions, signal words; and other special regulations (size, style, proportion, supplementary hazards, etc.)
3. Update product's SDS
Updated Section 2 (Hazard Identification) and Section 16 (Further Supplements and Clarifications) in the SDS.
Prepare SDS that meets both REACH and CLP requirements!
4. Notify ECHA
(Notification only applies to companies within the EU, but ECHA recommends that non-EU companies can ask OR to notify the company's importers of CLP in a "flexible" way.)
If REACH registration is completed by the end of 2010, the registration dossier contains CLP classification and can be exempted from notification; the first batch of substance notifications is due on January 3, 2011. Future products must be notified within 1 month of being put on the market.
